Licence of right
A licence of right allows anyone to get a licence for your patent. You
can use Patents form 28
(24Kb) to apply for a licence of right.
We have a database of patents that are endorsed Licence of Right.
After we publish the grant of your patent in the Patents Journal you may apply for a licence of right entry to be included in the register of patents.
There is no fee for this.
Your application must be sent at least 10 days before renewal, to allow us time to enter it into the register and so that you only pay half the usual fee.
On the form you must say that you are not prevented by contract from granting licences under the patent.
Before we make the entry to the register, we will tell everyone who is registered as having a right in the patent and give them 14 days to reply.
When we are satisfied that the grant of licence can be allowed, we will make an entry in the register.

What happens next?
We will stamp and return the tear-off slip to confirming that we have made the entry and publish this in the Patents Journal.
Anyone with a legal interest in the patent will have 2 months from this journal notice to apply to cancel the entry.
A licence of right cannot take effect until you and the licensee have agreed its terms. If you cannot agree, either of you can apply to us to decide the terms.
